§ 10-43. Cash performance bond.

  • (a)

    A cash performance bond will be required for special events where the proposed constant attendance will be greater than 1,000 patrons. The cash performance bond shall be deposited with the building official in the form of a cashier's check or certified check, made payable to the Board of County Commissioners of Brevard County, Florida. A cash performance bond is not required when the sponsor or provider of a special event owns the property where the special event will take place. The amount of the cash performance bond will be determined as follows:

    (1)

    $50.00 for each tent or booth.

    (2)

    $25.00 for each game, ride or device.

    (b)

    The cash bond shall be utilized by the county for the following:

    (1)

    Cleaning up garbage, sewage, dirt, paper, litter or other debris left on county property or right-of-way.

    (2)

    Damage to county property resulting from the permitted activity.

    (3)

    Enforcing compliance with the provisions of this article.

    (c)

    The cash bond or the remaining portion of the bond shall be returned to the applicant after the building official or his designee verifies that within three working days after the completion of the special event, all property damage is repaired or replaced and the sponsor or provider has otherwise fulfilled its responsibilities pursuant to this article.

    (d)

    If the cost of damages exhaust the amount of the bond determined in subsection (a) the event will be closed until such time as a bond representing two times the amount of the initial cash bond is deposited with the building official. In the event the permitted activity has ended, the county shall have the right to take any corrective action necessary.

    (e)

    Nothing in this section shall be interpreted to limit the liability of the applicant or any other person to the amount of cash bond deposited by or on behalf of the applicant.
