§ 110-236. Authorized; scope.
The county shall have the power to contract with any developer seeking to establish and construct a new water or sewerage system or an existing public utility seeking to substantially alter, expand or improve its existing water and sewerage system or facilities for the purpose of entering into the optional agreement specified in this subdivision. The election to enter into the optional agreement shall be within the complete discretion of the board of county commissioners upon application by the developer or public utility. Upon the final execution of the optional agreement and approval by the board at a public hearing, the provisions of the final executed optional agreement shall control as to the acquisition of the water and sewerage facilities and the provisions of subdivision 1 of this division shall be inapplicable to the developer or public utility unless the subdivision is expressly made so applicable in the final executed optional agreement or in another section of this division.
