§ 110-261. Definition.

For the purposes of this subdivision an independent public utility is one in which no developer, corporate or otherwise, whose land or development is to be served by the public utility has any financial interest at any time, past, present or future. The term "developer" includes all agents and employees, and all stockholders, officers or directors, if the developer is a corporation.
