§ 30-25. Preferential or discriminatory practices prohibited.
(a)
Nondiscriminatory rates. The franchisee shall comply with all applicable laws and regulations concerning nondiscriminatory rates. The franchisee's charges and rates for all services shall be itemized on subscribers' monthly bills.
(b)
Nondiscrimination required. The franchisee shall not deny service, deny access, or otherwise discriminate against subscribers, channel users or general citizens on the basis of race, color, religion, national origin, age, sex, or physical or mental handicaps as provided for in the Cable Act, provided the subscriber pays all applicable fees for the service(s) desired. The franchisee shall comply at all times with all other applicable federal, state and local laws and regulations, and all executive and administrative orders and rates relating to nondiscrimination which are hereby incorporated and made part of this chapter by reference. The franchisee shall abide by all FCC rules and regulations concerning closed captioning.
(c)
Fairness of accessibility. The franchisee shall abide by the Americans with Disabilities Act which governs issues of accessibility.
(d)
Information accessibility.
(1)
Each individual subscribing to the services of the system thereof shall be provided with all rules and regulations specifically outlining certain terms and conditions of services pertinent to such use.
(2)
Each document required to be maintained, prepared, filed or submitted under the provisions of this chapter or pursuant to it, except those required and designated proprietary by the franchisee or other public law or regulation is a public document, available for public inspection and copying at the requester's expense, at the office of the county during normal business hours. The charge for such copying shall approximate the cost of mechanical reproduction and shall not include a charge for labor.
(3)
The county shall maintain confidentiality of information provided by the franchisee when the franchisee has designated such information as proprietary. The county shall provide the franchisee with notice of any request by a third party for such information.
