§ 30-29. Governmental, educational and institutional services.

  • (a)

    Institutional network. The county may request that the franchisee construct, install, operate and maintain a separate institutional network in addition to the residential subscriber network as specified in this chapter. If requested and agreed to by the franchisee, the institutional network shall be constructed and operated as provided in the franchise.

    (b)

    Emergency override. The franchisee shall either provide compensation to the county to purchase and install equipment, or provide and install the necessary equipment to automatically interrupt programming on all channels of the system by means of an audio and visual message to present emergency information by public officials of the county. Such equipment shall be accessible, at a minimum, from the county's emergency operations center, and the county shall incur no cost, fee, or charge for said equipment, installation, operation, or maintenance thereof.

    (c)

    Access channels. The franchisee shall provide and maintain the following type(s) of access channels in accordance with the Cable Act. Educational and governmental access channel assignments shall be on the basic tier of service and not be changed unless there is a good cause and the change shall not be unreasonably withheld. Access channel assignments should be the same throughout the franchisee's system. If the franchisee decides to change the channel designations for the educational and governmental access channels, it must provide 30 days' notice to the county prior to doing so. If the franchisee subsequently decides to change the educational and governmental access channels to digital capacity, the franchisee shall allow the county and school board a minimum of six months for conversion.

    (1)

    Government access channel. A government access channel shall be a specifically designated channel for non-commercial local government use, at no charge to the county, and shall be shared by the other franchising authorities served by the same system. The channel shall be managed, scheduled and programmed exclusively by the county and those county municipalities wishing to participate.

    (2)

    Educational access channel. An educational access channel shall be a specifically designated channel for non-commercial use by local public school authorities on a first-come, first-served, non-discriminatory basis and shall be managed, scheduled and programmed exclusively by the school board.

    (3)

    Leased access. Subject to the Cable Act and FCC rules and regulations, the franchisee shall provide leased access in accordance with federal law.
