§ 34-43. Method of selection.
The APPAC shall be responsible for coordinating the process for the selection of works of applied art according to the following provisions:
(1)
The county administrator or his designee shall inform the APPAC of proposed construction projects for new or expanding public facilities prior to the time that requests for proposals are issued for the architectural and engineering design phase of the construction projects. Such requests for proposals shall inform the bidder of the requirements of the Brevard County Art in Public Places Program as defined by this article.
(2)
Works of applied art shall be selected through a two-phase, open competition process and the APPAC shall be responsible for soliciting requests for proposals from visual artists upon direction from the board of county commissioners. The architect and landscape architect selected to design the associated public facility construction project shall assist the APPAC in developing the parameters of the request for proposals. The request for proposals shall identify the budgeted amount from the appropriation to be available for completion of the art work to be selected. At a minimum, requests for submissions shall be noticed in a legal advertisement in a local newspaper of general circulation.
(3)
The first phase of the selection process shall require that the APPAC solicit information, through requests for proposals, from visual artists interested in participating in the competition to demonstrate their past experience and appropriateness of work for the applicable public place for which works of applied art are to be selected. The APPAC shall review the submissions based upon the selection criteria under section 34-42 and shall select not more than five and not less than three visual artists as selection finalists. The board of county commissioners shall reserve the authority to veto the decision of the APPAC with regard to the selection finalists. The following information shall be submitted to assist this review:

Visual artists shall be required to submit four to six color slides of current works completed within the past five years. The slides should be marked with the title of the work, medium, date completed, artist's name, and with the top and front of the work noted. A self-addressed envelope shall be included with each submission for return of all slides.
b.
Each visual artist shall also submit a resume detailing the artist's overall experience as well as experience in the chosen medium.
c.
Each visual artist shall be allowed to submit scale models or maquettes of works of art completed within the past five years.
(4)
The second phase of the selection process shall require that the APPAC request the selection finalists to submit an original design that would be appropriate for use in the applicable public place. The following provisions shall be adhered to in the second phase:
a.
The county may reimburse the selection finalists for completion of the original design work. The amount to be paid to each selection finalist shall be determined by the sole discretion of the board of county commissioners, following selection of the finalists. In establishing the fees, the board shall consider the appropriateness of the fees with relation to the extent of design preparation necessary for creating a work of applied art for the applicable public place based upon a recommendation of the APPAC.
b.
Architectural and site design plans shall be made available for review by the selection finalists to ensure the appropriateness of the original designs with relation to the character of the site.
c.
The APPAC shall review all original designs and select no more than three prioritized alternate submissions. The board of county commissioners shall reserve the authority to veto the decision of the APPAC regarding final selection. This selection shall be based upon the criteria established in section 34-42 and shall be coordinated through the county administrator or his designee.
(5)
Following the final selection by the APPAC, the county administrator or his designee shall prepare and negotiate a contract, under the budget pursuant to this section and section 34-44, with the visual artist for purchase, commission or loan of the work. The APPAC shall assist the county administrator or his designee in coordinating with the visual artist and in administration of the contract.
