§ 42-94. Insurance and indemnification.
(a)
Every certificated nongovernmental EMS provider and non-emergency medical transportation service shall carry bodily injury and property damage insurance with solvent and responsible insurers authorized to transact business in the state to secure payment for any loss or damage resulting from any occurrence arising out of or caused by the operation or use of any of the certificate holder's motorized vehicles. Each vehicle, including water craft or aircraft, shall be insured for the sum of at least $1,000,000.00 per occurrence for injuries to or death of one or more persons and for damage to property. Each nongovernmental EMS provider shall maintain malpractice insurance in the amount of not less than $1,000,000.00 per claim. Every insurance policy or contract for such insurance shall provide for the payment and satisfaction of any financial judgment entered against the operation or any person driving a vehicle of the operator. Certificates of or certified copies of each policy shall be filed with the manager by filing such copy of a certified copy of such policy with the risk management division of the county. All such insurance policies, certificates or certified copies thereof shall provide for 30 days prior notice of cancellation to the director. Vehicle liability policies shall cover the board as an additional insured.
(b)
Every local government certificate holder shall either furnish evidence of bodily injury, property damage and malpractice insurance in an amount equal to that for which it would be held liable pursuant to the provisions of F.S. § 768.28, or such other local governments may furnish a certificate of self-insurance evidencing that it has established an adequate self-insurance plan to cover such risks.
(c)
Every nongovernmental certificate holder shall enter into an agreement to hold the county and the board harmless from all claims arising from the activities of the EMS provider.
