§ 50-82. Fines for repeat offenses.

  • (a)

    Should the person cited by a fire code enforcement officer be found in violation of the same provision of the fire codes and ordinances of the county within one year of the date of the original citation, a penalty established by the fire prevention and protection citation rate resolution shall be imposed subject to issuance of the second citation. The person cited shall have 30 days from the date of the citation to pay a reduced civil penalty or to schedule a hearing on the citation.

    (b)

    Should the person cited by a fire code enforcement officer be found in violation of the same provision of the fire codes and ordinances of the county for a third occurrence within one year of the date of the original citation, a penalty established by the fire prevention and protection citation rate resolution shall be imposed subject to issuance of the third citation. The person cited shall have 30 days from the date of the citation to pay a reduced civil penalty or to schedule a hearing on the citation.

    (c)

    Subsequent repeat violations of the same provision of the county fire codes and ordinances, within one year of the date of the original citation shall be subject to penalties established by the fire prevention and protection citation rate resolution upon issuance of a fourth or subsequent citation. The person cited shall have 30 days from the date of the citation to pay the civil penalty established by the fire prevention and protection [citation rate resolution] or to schedule a hearing on the citation.
