Chapter 74. OFFENSES AND MISCELLANEOUS PROVISIONS |
Article IV. NUISANCE ABATEMENT |
§ 74-79. Definitions.
For the purpose of this article the following definitions shall apply:
Board of county commissioners: The Brevard County Board of County Commissioners.
Controlled substance: Includes any substance sold in lieu of a controlled substance in violation of Section 817.563, Florida Statutes, or any imitation controlled substance defined in Section 817.564.
County commission: The Brevard County Board of County Commissioners.
Public nuisance: Any place or premise which has been used on more than two occasions within a six-month period:
(1)
As the site of a violation of Section 796.07, Florida Statutes, prohibiting prostitution; or
(2)
As the site of the unlawful sale, delivery, manufacture, distribution, use or cultivation of any controlled substance, or
(3)
On one occasion as the site of the unlawful possession of a controlled substance, where such possession constitutes a felony and that has been previously used on more than one occasion as the site of the unlawful sale, delivery, manufacture, distribution, use or cultivation of any controlled substance; or
(4)
Any place or building used by a criminal street gang for the purpose of conducting a pattern of criminal street gang activity.
(5)
As the site of the dealing in stolen property.
(6)
As the site of illegal gambling.
(7)
As the site of unpermitted rave clubs.
(8)
As the site of illegal alcohol sales.
(9)
As the site of lewd and lascivious behavior as defined by Chapter 800 of the Statutes of Florida.
