§ 82-15. Activities prohibited.

  • (a)

    No officer, employee or person shall use or promise to use, directly or indirectly, any official authority or influence to secure any person an appointment or advantage in appointment to the county service, or an increase in pay or related consideration, for the purpose of influencing the vote or political action of any person.

    (b)

    No person shall be appointed or promoted to, or demoted or dismissed from, any position in the career service or be favored or discriminated against because of political opinion or affiliation, religious belief, race, color, gender, national origin, ancestry, age, marital status or physical or mental disability if such disability does not preclude the performance of the essential functions of the job, with reasonable accommodations provided as necessary.

    (c)

    No person shall directly or indirectly give, render, pay, offer, solicit or accept any money, service or other valuable consideration for or on account of any appointment, proposed appointment, promotion or proposed promotion to, or any advantage in, a position in the county service.

    (d)

    No employee, officer, official or other person shall defeat, deceive or obstruct any person in his right to examination, eligibility, certification or appointment under this chapter.

    (e)

    No officer or employee in the county service shall solicit any assessments, contributions or services for any political party from any employee in the career service.

    (f)

    Nothing contained in this section shall affect the right of the employee to hold membership in and support a political party, to attend political meetings, to express privately his opinions on all political subjects and candidates, to maintain political neutrality, or to vote as he chooses.

    (g)

    No person in county service shall participate in any partisan political activity prohibited by the Federal Hatch Political Activities Act, as amended, 5 U.S.C. 1501 through 1508, if such person is employed in a federal grant-aided program.
