§ 86-136. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Farmer's stand means a roadside stand operated by the landowner of agriculturally zoned property to sell produce grown on that site to the general public.

    Mobile vendor means a person or business conducting the sale of immediately consumable prepared food products, including but not limited to hot dogs, sandwiches, ice cream and nonalcoholic beverages from a mobile vehicle. Sales are to be oriented to pedestrians, not motorists, and the vehicle is to keep moving except for the purpose of making a sale and normal traffic considerations.

    Operate means to set up, run, maintain or manage a roadside stand, farmer's stand or mobile vendor vehicle.

    Public road means any paved road within the unincorporated area of the county, including streets, shoulders, medians and all other ways open to public travel by operators of motorized vehicles.

    Right-of-way means land in which the county or state owns the fee or has an easement devoted to or required for the use of a public road, or land abutting a paved road which has been maintained by the county or state, or, if ditches exist, the land lying between the ditches on either side of any public road and the edge of the pavement of such public road.

    Roadside stand means any motor vehicle, stall, building, tent, counter or other method or device which is being utilized for the temporary display, storage or sale of any type of goods or services and which shall not exceed 200 square feet.
