§ 98-245. District governing body.

  • The governing body of the district shall be known as the North Brevard Development District Board.

    (1)

    The district board shall be composed of nine members. The office of each member shall be for a term of four years beginning on the first day of January.

    (2)

    Three district board members shall be appointed by the District 1 County Commissioner.

    (3)

    Three district board members shall be appointed by the City of Titusville.

    (4)

    Three district board members shall be appointed by the board of county commissioners with the approval of the Titusville City Council.

    (5)

    Unless a nonresident is approved by a majority of the county commission and the Titusville City Council, all district board members shall reside within the boundaries of the North Brevard Development District. In the event any district board member resigns or ceases to reside within the boundaries of the district, the office of such member shall be deemed vacant as of the date of such event. Any vacancy occurring in any office of a member shall be filled for the remainder of the unexpired term in the manner provided for regular appointments.

    a.

    Following the initial terms described below, district board members shall serve staggered four-year terms. One of the initial members appointed by the District 1 Commissioner and one of the members appointed by City of Titusville and two of the members appointed by the board of county commissioners shall serve initial terms of two years.

    b.

    The remaining five initial appointments shall serve initial terms of four years.

    (6)

    Each district board member shall serve until their successor is appointed as herein provided.

    (7)

    The initial term shall commence on the date specified in the appointment for a time period to include a full four-year or initial term as defined subsection (5) of this section.

    (8)

    District board members shall receive no compensation. However, district board members shall be entitled to such receive reimbursement of per diem expenses in such amounts as are authorized by law provided those expenses are pre-authorized by the district board and reasonably incurred in the performance of duties as a member of the district board.

    (9)

    All district members shall file financial disclosure forms and abide by all other provisions in the applicable Florida Code of Ethics for Public Officers and Employees as set forth in F.S. ch. 112, pt. III.

    (10)

    Upon a supermajority vote of the Brevard County Board of County Commissioners, any district board member may be removed from office for the unexpired portion of the term of such district board member. It is the intent of the county commission that the power to remove a district board member during an unexpired term will result in the classification of the North Brevard Economic District as a dependent district under the criteria provided in F.S. § 189.403(2).

    (11)

    The district board shall elect, by majority or plurality vote a chair, vice-chair and a secretary who will be responsible for recording minutes of all meetings of the district board. Upon entering into an interlocal agreement with the clerk of the circuit court payable from the trust fund created under the tax increment ordinance, the clerk may serve as secretary to the board.
