§ 98-247. Powers of the district.

  • The North Brevard Development District, operating through the district board, shall have the following powers:

    (1)

    To administer and implement the adopted economic development plan;

    (2)

    To enter into contracts and interlocal agreements consistent with the exercise of the district's powers, as set forth in this division;

    (3)

    To set up and maintain accounts, books and records required to perform duties, functions and powers under this division;

    (4)

    To expend funds maintained in the trust fund created under the tax increment ordinance for economic development purposes consistent with the requirements of Florida law, the economic development plan and the Brevard County Home Rule Charter;

    (5)

    To issue revenue bonds or certificates of indebtedness or other forms of indebtedness secured by a pledge of, or payable from, available funds maintained in the trust fund or other funds secured by the assignment of contract payment obligations incurred under state agency contracts with third parties or by other funding sources facilitated by the creation of an interlocal agreement agency through the execution of an interlocal agreement with one or more participating local governments or public entities; subject to any limitations in the Brevard County Home Rule Charter, authorize lease purchase obligations contingent upon annual appropriation from funds available to the North Brevard Development District; direct financial incentives of monetary assistance to a business including grants, loans, equity investments, loan insurance and guarantees, and training subsidies; indirect incentives in the form of grants and loans to businesses and community organizations providing support to businesses or promoting business investment or development;

    (6)

    To recommend to the county commission controlled fee-based incentives for businesses seeking to locate, relocate, expand or invest in North Brevard including impact fee credits or refunds, ad valorem or other tax exemptions and property tax abatement; assessment reductions; below-market rate leases or conveyances of county real property; and such other innovative incentives as may become available under law.

    (7)

    To own and lease property for economic development purposes consistent with the economic development plan;

    (8)

    To acquire real and personal property by purchase, lease, gift, grant or transfer from the county, state or federal government or any subdivision or agency thereof; from any other governmental entity; or from any other person, partnership, company, corporation, trust, foundation or other legal entity of any kind;

    (9)

    To contract for such services as may implement the economic development plan, provided, the hiring of any professional services or employees by the district board in lieu of utilizing county staff, shall require the express approval of the county commissioner;

    (10)

    To exercise such other powers as may be incidental to or implied from those described in this section;

    (11)

    To utilize counsel in the county attorney's office and county staff under the supervision of the county manager, as required.

    (12)

    In conjunction with and supplementary to its duties and powers relating to economic development, to prepare and develop comprehensive and specific plans or agreements for the development, expansion, assembly, exchange or improvements involving property within spaceport commerce park (formerly known as gateway center industrial park) for recommendation and consideration by the board of county commissioners.

    (13)

    To act as the agent of the board of county commissioners in the negotiation and execution, through its chairperson or vice-chairperson, of all contracts for the private sale or private lease of county-owned land within the boundaries of spacecoast commerce park, provided:

    a.

    That before any such contract becomes binding on the county the executed contract must be approved by the board of county commissioners;

    b.

    Pursuant to chapter 82-264, Laws of Florida, all such sale or lease agreements shall be exempt from the provisions of F.S. §§ 125.35—125.38.

    (14)

    To advise and to recommend to the board of county commissioners amendments to the set of deed restrictions and covenants affecting all real property within spaceport commerce park.
