§ 222-2. Authority to adopt standards and regulations for use of septic tanks.
(a)
It is the intent and purpose of this section to provide means by which the board of county commissioners of Brevard County can alleviate the pollution problems arising from high-density use of temporary septic tank systems for sewage disposal.
(b)
The board of county commissioners of Brevard County is hereby authorized to adopt such regulations establishing standards for the operation and use of septic tanks in Brevard County, including the areas within the corporate limits of municipalities in the county, as well as the unincorporated areas thereof. Such regulations may specifically include, but not be limited to, standards for soil conditions, groundwater table elevations, flooding conditions, percolation rates, and density of septic tank installations per open lot area as may be reasonably required to protect the public health and general welfare of the citizens of Brevard County; provided, however, that such regulations as may be adopted by the board of county commissioners of Brevard County may not be less stringent than the standards adopted by the Florida state board of health.
(c)
The board of county commissioners of Brevard County is hereby authorized to enforce such regulations adopted under the authority of this section by the Brevard County health department as an agency of the Florida state board of health.
