§ 222-54. Same—Discretion in granting.
In determining under what conditions and to what extent a variance is necessary and will be permitted, the board of county commissioners or the court hearing the petition shall exercise a wide discretion in weighing the equities involved and the advantages and disadvantages to the residents of the area and to any lawful business, occupation or activity involved resulting from requiring compliance with the specified require- ments or resulting from granting a variance. In the event of a change in conditions resulting in a substantial change in the equities involved and in the advantages and disadvantages existing at the time of granting a variance, the board of county commissioners may revoke or modify the order permitting the variance by written order after a public hearing held upon a 30-day notice to the persons or classes affected.
