§ 258-85. Powers of eminent domain; exceptions.

The powers of eminent domain granted to the authority by this article shall not be exercised to acquire any portion of an investor-owned water utility, including such utility's water system or water distribution system. Investor-owned water utility systems operating under a valid franchise are specifically exempted from all provisions of this article except section 258-78(6).
