§ 258-108. Systems regulated by Florida Public Service Commission.
The Florida Public Service Commission shall have jurisdiction over all public utilities as defined in F.S. ch. 367, operating in Brevard County regardless of the number of water or sewer service connections of said water or sewer systems with the sole and specific exception of the owner or operator of any public lodging establishment owning or operating water or sewer systems primarily in connection with service to guests and the owner or operator of a water or sewer system serving less than 25 connections primarily as an accommodation to those served thereby, whether or not a charge is made for such service. This section shall control over any inconsistent provision defining public utility, or any other inconsistent provision in said F.S. ch. 367.
