§ 258-177. Definitions.
As used in this act:
Agency, as the context requires, means an official, officer, commission, authority, council, committee, department, division, bureau, board, section or other unit or entity of government, including a regional or local governmental entity.
Amendment means a material change in the information provided by the applicant to the application for certification made after the initial application filing.
Applicant means any electric utility which applies for a permit pursuant to the provisions of this article.
Application means the documents required by the board to be filed to initiate a permit proceeding and shall include the documents necessary for the board to render a decision on any permit required pursuant to this article.
Board means the board of county commissioners of the county, sitting as the permitting board.
Corridor means the proposed area within which an associated linear facility (transmission line) right-of-way is to be located. After all property interests required for the right-of-way have been acquired by the applicant, the boundaries of the area permitted shall narrow to only that land within the boundaries of the right-of-way.
Corridor permit means the written order of the board approving an application in whole or with such changes or conditions as the board may deem appropriate.
Electric utility means cities and towns, counties, public utility districts, regulated electric companies, electric cooperatives and joint operating agencies, or combinations thereof, engaged in or authorized to engage in the business of generating, transmitting or distributing electric energy.
Modification means any change in the permit after issuance, including a change in the conditions of the permit.
Ordinance means the electrical transmission line permitting ordinance.
Right-of-way means existing county-controlled public right-of-way, easement, license or other interest in or a right to use land over which a transmission line is proposed to be constructed.
Site means any proposed location wherein an electrical transmission line or alteration or addition resulting in an increase in generating capacity, will be located within the incorporated or unincorporated area.
Staff means the county manager or his designee.
Transmission line means any overhead electrical transmission line which is designed to operate at less than 230 kilovolts. The starting point and ending point of a transmission line must be specifically defined by the applicant. A transmission line includes structures and access roads that need to be constructed for the project to become operational. The term "transmission line" also includes any transmission line designed to operate at 230 kilovolts or more which is exempt from certification under the provisions of F.S. § 403.524.
