§ 262-29. Designation as public highways; authority to establish speed limits; exceptions of municipal beaches.

  • The public beaches of Brevard County are hereby declared to be public highways, and the board of county commissioners of the county is hereby authorized to establish and set speed limits on all such beaches or on any of them or on any portion of any or all of them. Prior to any such speed limit becoming effective and enforceable, it shall be published one time in a newspaper of general circulation in Brevard County. The board of county commissioners of Brevard County is further authorized to erect or cause to be erected upon such beach or beaches appropriate markers or signs denoting the speed limit on such beach or beaches or on any portion thereof. No speed limit set by the board of county commissioners pursuant to this section shall apply on any beach upon which any municipality of Brevard County has or shall, pursuant to authority granted by any act of the legislature, set a speed limit.
