§ 62-1926. Electric, natural gas, water and wastewater utilities in the GML(U) zoning classification.

  • Certain electric, natural gas, water and wastewater utilities may be permitted as a conditional use in the GML(U) zoning classification under the following conditions:

    (1)

    The utility must be either publicly owned or regulated by the Public Service Commission. "Merchant" or "wholesale" electric generation facilities shall be regulated as a heavy industrial use as described in section 62-1102.

    (2)

    The applicant shall provide data and analysis demonstrating that that the facility will meet all applicable performance standards of chapter 62, article vi, division 6, subdivision iiI, Brevard County Code.

    (3)

    The board may require additional setbacks, buffers or other means to mitigate any potential adverse impacts and insure compatibility with the surrounding land uses according to the general standards of review in section 62-1901(c).

    (4)

    Electric generation facilities shall also meet the following location standards:
