§ 62-1941.5. Performance Overlay District.
A request for a POD will be granted based upon the current CUP review criteria (sec. 62-1901) as well as the following location criteria. The following location criteria will need to be satisfied prior to the application being accepted for board consideration. The location criteria will include:
(1)
The site must contain an existing shopping center or structure that is at least ten years old.
(2)
The site shall contain at least 21,800 square feet of floor area.
(3)
The site shall not abut a residential zoning classification.
(4)
The site shall have a vacancy ratio of 50 percent or greater.
(5)
The site shall have tenant space that has been vacant for at least one year.
