§ 62-2134. Flexible design of subdivision lots.

  • Any new subdivision plat which is recorded pursuant to section 62-2804 of this Code and which has at least ten lots may contain lots that are below the minimum lot size, lot width, and lot depth established under the applicable zoning classification under the following conditions:

    (1)

    The minimum lot size or dimensions established under the applicable zoning classification shall be considered to be averages for the purpose of this section.

    (2)

    No lot size or dimension shall be more than ten percent below the minimum lot size or dimension established under the applicable zoning classification.

    (3)

    For each lot having a lot size or dimension smaller than the minimum established under the applicable zoning classification, there shall be a separate and distinct lot which has a lot size or dimension that is larger by an equal or greater amount.

    (4)

    Lots that are at least twice the size of the minimum lot size established under the applicable zoning classification shall not be used to offset lots which are undersized pursuant to this provision.

    (5)

    Under no circumstances shall this provision be used to increase the number of lots recorded beyond the density established by the county comprehensive plan.
