§ 62-2253. Determination of violations.

  • Determinations necessary for administration and enforcement of performance standards set forth in this subdivision range from those which can be made with satisfactory accuracy by a reasonable person using normal senses and no mechanical equipment to those requiring great technical competence and complex equipment for precise measurement. It is the intent of this subdivision that, where determination can be made by the code enforcement officer using equipment normally available to the county or obtainable without extraordinary expense, such determination shall be made before notice of violation is issued. Where technical complexity or extraordinary expense makes it unreasonable for the county to maintain the personnel or equipment necessary for making difficult or unusual determinations, the cost of proving to the county man ager or designee that violations have not occurred shall rest with those accused of such violations, with such determinations to be made as required at the discretion of the county manager or designee.
