§ 62-2881. Planned unit developments.

  • The development of a subdivision as a planned unit development under the zoning regulations of the county shall be in conformity with such zoning regulations and the final development plan for a planned unit development, and other applicable requirements under this code. The board shall have the right to waive or vary the design, dedication and construction requirements of such a planned unit development from any of the provisions of this code if the proposed final development plan is in conformity with the requirement of such zoning regulations for a planned unit development and provided that:

    (1)

    Such waiver does not violate the purpose and intent of any requirement of this article for the protection of the public health, safety and welfare in the subdivision of land.

    (2)

    All procedures specified in this article for the approval of a final plat for recording or the issuance of a certificate of completion, as the case may be, are strictly adhered to.

    (3)

    All exhibits, certificates and information required in this article for the approval of a preliminary and final plat and the issuance of a certificate of completion, are strictly adhered to under the applicable specified procedures.
