§ 38-9. County misdemeanor drug/alcohol court cost.

  • (a)

    Title. This section shall be known and may be cited as the "Brevard County Misdemeanor Drug/Alcohol Court Cost Ordinance".

    (b)

    Authority. This section is enacted pursuant to F.S. § 938.13, which section authorizes a county as a political subdivision of the state to authorize by ordinance the courts to impose an additional $15.00 cost under the circumstances set forth.

    (c)

    Additional cost imposed. There shall be imposed an additional cost in the amount of $15.00 upon each defendant in any court located in the county found guilty of any misdemeanor involving the unlawful use of drugs or alcohol. Fourteen dollars of each said additional cost shall be remitted to the county board of county commissioners pursuant to F.S. § 938.13 for deposit into the county alcohol and other drug abuse trust fund. One dollar of each $15.00 collected shall be retained by the clerk of the court as a service charge.
