§ 82-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Administrative personnel and officers means employees in positions at the level of administrative officer II and above who serve at the pleasure of the board of county commissioners, and the county manager, a state officer, county officer, or other legally constituted appointing authority established by statute, ordinance or corporate charter.

    Appointive members of boards, commissions and committees means any person who is appointed by the board of county commissioners to serve as a member of any county board, commission or committee.

    Certificate of eligibles means the officially promulgated list of eligible persons for an open position.

    Conviction means a determination of guilt at trial, a plea of guilty or a plea of nolo contendere, regardless of whether final adjudication is withheld or delayed.

    County officers means the board of county commissioners and other elected officials of the county, and officials of the county appointed by the governor of the state.

    County service means all employees who receive salaries, wages or compensation directly funded by the board of county commissioners and all employees of any agency, commission, council, county officer, board or department which enters into an agreement with the board of county commissioners to become subject to the provisions of this chapter.

    Educational personnel means any person whose employment is jointly overseen by the county and an institution of higher learning.

    Effective date means the day a suspension, demotion, placement on disciplinary probation, or dismissal commences or the day an appointment is denied.

    Good cause means negligence, inefficiency, unexcused absence, unfitness to perform, insubordination, incompetency, misfeasance, malfeasance, conviction of a felony or any crime involving immoral conduct, misconduct which is job related or affects job performance, the violation of any provision of this chapter or any personnel policy, or other cause which is detrimental to the discipline and efficiency of the county service. The standard for good cause for suspension, demotion, placement on disciplinary probation or dismissal may be established by measuring the conduct and performance of the employee against the conduct and performance of other similarly situated county employees.

    Personnel policy means a policy which governs employees in county service and which has been duly adopted by the board of county commissioners.

    Position means an office of employment composed of specific duties.

    Private staff means a personal staff member of a county officer or state officer who serves at the pleasure of such officer.

    Probationary employee means an employee serving a fixed probationary period prior to appointment and/or promotion to a permanent position in the career service. A probationary employee is subject to and receives all the benefits and rights as may be provided by the policies, except the right of appeal provided in section 82-13.

    Professional or consultant employees means any person employed to perform services in a professional or consultant capacity on a contractual, fee or retainer basis.

    Special assistants means special or administrative assistants to a county or state officer who serves at the pleasure of such officer.

    Special project employee means any person hired to perform services for the length of a project or special program which is not expected to be permanent in nature.

    State officer means any officer elected by the public or appointed by the governor who supervises employees in the county service.

    Suspension means an enforced leave of absence for disciplinary purposes or pending an investigation of charges made against an employee or during the period that criminal charges are pending against an employee.

    Temporary employee means any employee in county service who, at the time of appointment, is expected to be employed for a period of less than 1,040 consecutive working hours.

    Transfer means a change from one position to another in the same class or in another class having substantially the same entry salary as described in section 82-10.

    Volunteers means any person performing services for the county without receiving compensation for such services.
