Division 3. WATER AND NAVIGATION CONTROL AUTHORITY |
§ 202-202. Definitions.
As used in this division:
Cost, as applied to the acquisition, construction, reconstruction, improvement, maintenance and operation of water control and navigation facilities, includes the cost of construction, reconstruction, acquisition, improvement, maintenance and operation, including but not limited to the following: the cost of all labor, materials, machinery and equipment; the cost of all lands and interest therein, real or personal property, rights, easements and franchises of any nature; financing charges; interest prior to and during construction and for not more than two years after completion of the acquisition, construction, reconstruction or improvement of such water control and navigation facilities; the creation of initial reserve or debt service funds; bond discount, if any; cost of plans and specifications, surveys and estimates of costs and revenues; cost of engineering, financial and legal services; and all other expenses necessary or incidental in determining the feasibility or practicability of such acquisition, construction, reconstruction, improvement, maintenance and operation; administrative expenses and such other expenses as may be necessary or incidental to financing authorized by this division, including reimbursement of any moneys advanced on behalf of the county in connection with any of the foregoing items of cost.
County board means the board of county commissioners of Brevard County, acting as the governing authority of the Brevard County water and navigation control authority.
County clerk means the clerk of the circuit court in and for Brevard County and ex officio clerk of the county board.
District obligation bonds means bonds or other obligations secured by the full faith and credit of the taxing districts within the county and payable from ad valorem taxes levied and collected on all taxable property within the districts.
Navigation facilities are those facilities so designated by the county board upon recommendation of the county engineer or consulting engineer and after public hearing or public notice has been held or given in the manner provided by this article, and shall include canals, lakes, creeks, rivers, locks, docks, slips and ramps.
Permit means the written approval of the county commission or its agent to proceed with the work for which the permit application is made.
Primary water control facilities are those water control facilities in the St. Johns River basin that are provided, maintained and operated by the federal government or the Central and Southern Florida Flood Control District in accordance with the authorized plan of the Central and Southern Florida Flood Control Plan, house document 643, 80th Congress, second session, and subsequent amendments.
Secondary water conservation and control facilities are those water control facilities so designated by the county board upon recommendation of the county engineer or consulting engineer and after public hearing or public notice has been held or given in the manner provided by this article, and includes lakes, ponds, streams, major canals and other natural or manmade water control facilities for the collection and control of drainage waters and for transportation of such waters to the terminal disposition facilities, and storm sewers, ditches, minor flow canals, curb drainage systems, transporting and draining water from individual properties and local areas to the terminal disposition facilities.
Taxing district means any county commissioner's district in Brevard County as existing at the time of the issuance of any bonds.
Water control facilities means and includes any canals, ditches or other drainage facilities, reservoirs, dams, levees, sluiceways, dredging holding basins, floodways, pumping stations or any other works, structures or facilities for the conservation, control, development, utilization and disposal of water, and any purposes appurtenant, necessary or incidental thereto, and shall include all real and personal property and any interest therein, rights, easements and franchises of any nature relating to any such water control facilities and necessary or convenient for the construction, acquisition, operation and maintenance thereof, and reconstruction, if necessary.
