§ 254-68. Additional powers.

  • The district board, for and on behalf of the district, in addition to the other powers granted in this article, is hereby authorized and empowered to:

    (1)

    Make rules and regulations for its own government and proceedings and adopt an official seal for the district.

    (2)

    Employ such engineers, attorneys, accountants, financial or other experts and such other agents and employees as may be required or deemed necessary to effectuate the purposes of this division or in the alternative to contract for any of such services.

    (3)

    Acquire, construct, reconstruct or improve erosion prevention facilities in and for the district, including the acquisition of any erosion prevention facilities heretofore constructed by any person, firm, corporation or other body or heretofore partially constructed by any person, firm, corporation or other body and to complete such partially constructed erosion prevention facilities acquired by the district.

    (4)

    Borrow funds from time to time necessary to carry out the purposes of this article in an amount not to exceed the total amount of moneys produced by one annual ad valorem tax levy and the special assessments of property within the district, for a period not to exceed one year at a rate of interest not to exceed that authorized by general law.

    (5)

    Provide insurance coverage against loss by fire, windstorm or otherwise on any of the improvements or facilities on property real or personal of the district and public liability insurance covering the construction, operation or maintenance of any such improvements or facilities of the district or the activities of the district in connection with any purpose of this article.

    (6)

    Exercise jurisdiction, control and supervision over the construction of any erosion prevention facility as defined in this article, constructed or to be constructed by any person, firm, corporation, public or private, or public authority within the district and make and enforce such rules and regulations for the maintenance and operation of any such facilities as may in the judgment of the district board be necessary or desirable for the efficient operation of such facility and for accomplishing the purposes of this article.

    (7)

    Restrain, enjoin or otherwise prevent any person, firm or corporation, public or private, or public authority from establishing or constructing any erosion prevention facility within the district without prior written approval of the district board. Application for such approval shall be made in writing to the board in accordance with rules and regulations promulgated by the district board for that purpose; to restrain, enjoin or otherwise prevent the violation of any provision of this article or of any resolution, rule or regulation adopted pursuant to the powers granted by this article.

    (8)

    Make and enter into all contracts and agreements as the district board may determine necessary or incidental to the performance of its duties and to the execution of its powers under this article, including, but not limited to, contracts with the United States, the state of Florida, counties, municipalities, or any agencies of the foregoing, private persons, public and private corporations, and other political subdivisions.

    (9)

    Pay from funds available to the district under this article all reasonable and necessary expenses incurred in carrying out the purposes of this division, including reimbursement of actual travel expenses of members of the district board or their properly designated agents incurred in connection with the performance of their official duties upon approval by the district board.

    (10)

    Receive and accept from any source, including, but not limited to, the United States, the state of Florida, counties, municipalities, or any agencies of the foregoing, private persons, public and private corporations, and other political subdivisions, grants for or in aid of the construction, maintenance or operation of any erosion prevention facility or part thereof and receive and accept aid or contributions from any source of either money, property, labor or other things of value to be held, used and applied only for the purposes for which such grants or contributions may be made and to carry out the purposes of this article.

    (11)

    To raise annually such sums of money as the district board shall deem necessary for the purposes and needs of the district by levying a tax on all taxable real and personal property in Brevard County for the exclusive and proper use of the district, as provided in this article.

    (12)

    Levy and collect special assessments for special benefits received by oceanfront lands in the district as a result of the construction, operation and maintenance of any erosion prevention facility or beach restoration from the owners of the oceanfront land specially benefited, as provided in this article.

    (13)

    Operate, maintain and acquire by purchase or eminent domain in the name of Brevard County public recreation beaches or participate with other public bodies in the county in the operations, maintenance and acquisition of such beaches, or grant district funds to any other public body in the county for the operation, maintenance and acquisition of such beaches; provided, however, that in any district fiscal year, funds for that year's portion of the capital and maintenance and associated overhead costs of erosion prevention facilities shall first be set aside and only the remainder of district funds shall be available for funding public recreational beach operations, maintenance and acquisition.
