§ 62-2890. Design of waterway developments.

  • General: Waterway developments shall be designed so as to provide for the continuous circulation of water within its network of canals. Dead-end canals are prohibited. The applicant must make adequate provision for the private maintenance of canals in the future. Such provision shall include the designation of a party who shall be financially responsible for such maintenance and must be noted on the plat. Deed restrictions, if required by the county, shall be attached to the final plat as a separate instrument. Adequate provisions shall be made on the plat or through deed restrictions for rights of ingress and egress.
