§ 34-44. Ownership and maintenance.
Ownership of all works of applied art acquired under the provisions of this article shall be vested in the county. The county shall assume all responsibilities for custody, supervision, maintenance and preservation for all works of applied art acquired, through purchase or donation, or loaned under the county art in public places program. All documents, papers, designs, drawings, specifications and other such items received pursuant to this article are subject to state public records laws and shall be made available to the public upon demand. The APPAC shall be responsible for making recommendations to the board of county commissioners on the condition of art works selected and the need for repair, protection, preservation and maintenance. Permanent works of art shall not be relocated or destroyed without approval of the board of county commissioners following a recommendation from the APPAC. Portable works of art shall not be relocated without approval of the APPAC.
