§ 62-2896. Vacation of plats.
(a)
Should a replat be submitted, the area identified as public interest on the underlying plat of record shall be vacated prior to or simultaneously with final plat approval.
(b)
An applicant may apply for the vacation of any or any part of any plat at any time before the sale of any lot therein, by a written instrument, to which a copy of such plat shall be attached, requesting the same to be vacated.
(c)
When any lots in a subdivision have been sold, the plat may be vacated in the manner herein provided by all the owners of all the lots in such subdivision joining in the application in writing for such vacation.
(d)
The board will vacate any plat or part of a plat in accordance with the procedures established in F.S. ch. 177 if the board finds the vacation of the plat is in the public interest.
